A recent Indian court decision rejecting Novartis’ contention that the country’s patent laws are unconstitutional wasn’t simply about breaking a patent. Instead, the ruling said Big Pharma must be content to earn profits only on initial patents on an active ingredient, and that the industry will not get patent protection for incremental innovation in India as it does in the United States.
